The consubstantiality between human and social rights: towards a praxis of material and existential justice

This article analyzes the consubstantiality between human and social rights in the Constitution of the Bolivarian Republic of Venezuela (1999) as the foundation for a praxis of material and existential justice. Methodologically, it is framed within the critical-interpretative paradigm under a qualitative approach. The study is a basic-level, critical-hermeneutical documentary research, assuming a documentary-dogmatic design aimed at creating new legal constructs through the synthesis of pre-existing theories. The dialectical-hermeneutical circle is employed as the method, and the analysis technique used is critical discourse analysis Findings demonstrate that consubstantiality is the backbone of the Venezuelan legal system, manifested in the Preamble and Articles 2, 3, and 19, reclaiming the subject situated in their material corporeity as the cornerstone that enables the transition toward existential justice. It is concluded that the CRBV institutionalizes the Life-Criterion, where the protection of the material base is a condition for the validity of freedom. As a recommendation, Pro-Social Hermeneutics is proposed as a dogmatic shield that guarantees the primacy of human dignity and the immediate enforceability of social rights against regressive interpretations.
